Derrick Yancey’s disappearance timeline

Note: The Champion Newspaper received a copy of the timeline regarding the disappearance of double-murder suspect Derrick Yancey.  The timeline was compiled by DeKalb County Pre-trial investigator Tamara Lindsay.  The text has been slightly edited for clarity and space. Modifications appear in brackets. The text does appear in its entirety as was provided

According to a release issued by DeKalb County Magistrate Chief Judge, Winston P. Bethel, throughout the monitoring period several erroneous alerts were received by the monitoring service.  These alerts were the result of battery malfunctions and power outages.  Pretrial Services followed up on each of these erroneous alerts according to the release.

April 4, 2009

9:41am: Missed call was received from Ms. Franklin [possibly an employee of the monitoring company] and voice message was left.

9:46am: I checked my voice mail and retrieved Ms. Franklin’s message stating she received an alert regarding monitoring device.  She asked me to either call her back with Mr. Yancey’s number or call him myself.

9:56am: I returned the call to Ms. Franklin and spoke with her.  She was given Mr. Yancey’s number to the residence.  She stated that she received some type of signal that signified that the device had been tampered with.  I asked her to call me back once she had spoken with Mr. Yancey if there were any other problems.
 

10:17am: TC from Ms. Franklin stating that she spoke with Mr. Yancey’s brother who told her that he was outside washing the car and Mr. Yancey was in the bed sleeping.  She stated that she advised the brother that she needed to speak with him.  I advised her that I would call the residence as well to see if Mr. Yancey was available for me to speak with him.

10:37am: I made a call to the residence.  A male [at the residence] who stated Mr. Yancey wasn’t available.  I, then, asked him if he was there and he replied, “No.”  I asked him did he no[sic] where he was and he replied, “No, we hope he went to an appointment or something.”  I, then, advised the male that Mr. Yancey knows the procedure that he is supposed to follow when leaving the residence for appointments and his importance in contacting us ASAP upon his return to the residence.  He said, “OK.”

10:38am: TC to Ms. Franklin to advise her of the information that I obtained from the male [at the residence].  I advised her that this action from Mr. Yancey seemed strange due to the fact that he knows that he must receive permission from the courts when leaving the home for anything.  I advised her to write this up as a violation and to send me a report on Monday.  I, also, advised her that I would contact our Chief Magistrate for further direction and call her with an update.  I told her that I would check my work voice mail to see if any messages were left by Mr. Yancey. 

10:41am: TC to Braddye Smith[of DeKalb County Pretrial Services] and advised her of events.  She stated that she would call Judge Bethel and call me back with his direction.  I told her that while she called him that I would check my voice mail at work.

10:47am: TC to County Voice Mail System to retrieve any messages that may have been left on my direct line (404) 687-7110.  There were no messages at all from anyone.

10:47am: TC to Ms. Franklin and advised her that I had not received any messages on my personal line at work.  I advised her that I would call her ASAP with any new updates and for her to do the same. 

10:51am:  TC from Braddye Smith who stated she left a message for Judge Bethel to call her back upon receipt of message.

10:55am: TC to Mr. Yancey’s residence again.  Voice mail picked up and I left a message for anyone from the family to call me back ASAP.

11:07am: TC to Keith Adams’[Yancey’s Attorney] office to advise him of the events that had transpired.  Voice message was left for him to contact me ASAP.

3:41pm: TC from Braddye Smith advising me that she spoke with Judge Bethel who was going to contact

[Dekalb County Assistant District Attorney] Don Geary.  Also, she provided Judge Bethel & Don Geary’s contact numbers.  She asked me if I knew whether or not the monitoring company had gone out to the residence.  I told her that I did not think so.

4:54pm: TC from Braddye Smith stating that the Judge recommended that someone from the company go out to the residence to confirm that Mr. Yancey was not actually there and that it wasn’t simply a default in the device.

4:57pm: TC to Ms. Franklin and asked her if she could physically go to Mr. Yancey’s residence before further actions were taken.  She advised that she could and would.

6:28pm: TC from Major Cato [DKSO Swat Unit] inquiring about the events of the day regarding Mr. Yancey.  He asked me if I could come to the Sheriff’s Department with any information that I had.  I advised, “Yes” and that I would be on my way there.

6:32pm: TC to Judge Bethel and provided him with a brief summary of events.  He advised me to contact Don Geary.  I, also, advised him that the Sheriff’s Department had called for me to come in so that they could ask me some questions.

6:33pm: TC to Don Geary and provided him with a brief summary of events.  He wanted to know if anyone had been to the residence yet to be certain that Mr. Yancey was there.  I advised him that Ms. Franklin was on her way there now and would call me as soon as she arrived.  He asked me to call him as soon as I received an update.
I, also, advised him that the Sheriff’s Department had called for me to come in so that they could ask me some questions.

6:35pm: TC to Ms. Franklin who stated that she was approximately three minutes away from Mr. Yancey’s residence.  She stated she would call me as soon as she pulled up to the house.

6:39pm: TC from Ms. Franklin stating she had arrived at the residence.  She asked me to stay on the line w/her while she approached the door because she was by herself.  I heard her knock on the door and someone answered the door.  At that time, she asked an unknown person if that was the residence of Mr. Yancey.  I assume that whoever answered the door stated “yes”.  She then asked if he was there and if his mother was available.  She asked if they knew where he was or where he might be.  She, also, asked if the device had been cut and if it was available.  She asked if the person could go and get the device and bring it to her.  She advised me that she would call me back after she left the residence and that she just wanted me to hear the conversation between the people there.

6:42pm: TC to Don Geary to let him know that Mr. Yancey had left the resident and disconnected the device from his body.  He advised me to let the Sheriff’s Department know as well.

6:45pm: TC to DKSO and spoke with Lt. Leslie and advised him of the information received from Ms. Franklin regarding Mr. Yancey’s absence at the residence and the device being disconnected.  He asked if I could notify her to come to the department as well.  I advised him that I would. 

6:46pm: TC from Ms. Franklin and advised her to meet the SWAT Team at DKSO on Memorial Drive.  She stated that she would.

6:50pm: I arrived at DKSO and met with SWAT Team to discuss the events of the day.  They asked me if I had access to any files or release information for Mr. Yancey.  I advised them that I did and that I would need to go to the Courthouse to retrieve those documents from my office.

7:12pm: TC to Ms. Franklin to tell her to ask for Lt. Leslie or Major Cato upon her arrival to the Jail Warrant Division.

7:24pm: I arrived at the Courthouse and gained entry into the building by Deputy Perrymon.

7:40pm: I arrived back to DKSO and provided information from Mr. Yancey’s file.  That information was copied by Sgt. Akies and returned to me.

Lt. Leslie & Lt. Scandrick asked additional questions before dismissing me @ 8:15pm.  My contact information was left in the event that anyone had additional concerns or questions.

 

April 5, 2009

11:03am: Missed called received from local number; no message was left.

11:25am: Missed called received from local number; voice message left from Judge Bethel advising me to contact Mr. Geary to give him Ms. Franklin’s contact numbers so that he may subpoena her to court on tomorrow.  Also, he advised to call him back and let him know that message was received.

11:45am: TC to Mr. Geary.  I spoke with Mr. Geary who was given Ms. Franklin’s contact numbers [cell & office].

11:47am: TC to Judge Bethel.  I left a voice message advising him that I received his message and to let him know that Mr. Geary had been contacted with the information he requested.

 

APRIL 6, 2009

7:43am: Missed call received from Don Geary; No message was left.

7:58am: TC to Don Geary and advised him that I notice that I missed his call earlier.  He stated he had tried to contact Ms. Franklin and was unsuccessful.  He asked me to see if I could reach her and have her to call him, if I spoke with her.

8:00am: TC to Ms. Franklin and advised her that Mr. Geary was trying to contact her to see if she could be available for court this morning.  She advised me to have him call her.

8:04am: TC to Mr. Geary and advised him that Ms. Franklin stated for him to call her.  Mr. Geary stated that he would.

10:00am: Revocation Hearing was held before Judge Hunter who inquired about the events that took place on 4/4/09.  After hearing information from me and Ms. Franklin, she ruled that neither of us were in contempt and that she would schedule a meeting w/Judge Bethel upon his return to address procedure and protocol in the event of future incidents.

12:02pm: TC from Judge Bethel inquiring about the events from the hearing.  He was given a brief overview of things discussed in the hearing and stated he would speak w/Judge Hunter upon his return from his conference.

1:30-1:45pm: TC from Sabrina Hill [Judge Bethel’s assistant] requesting a timeline of events.  I emailed the information to her.

2:00pm: TC from Sabrina Hill requesting a copy of Mr. Yancey’s bond order.  The order was delivered to her.

2:25pm: Missed call was received from Lt. Akins @ DKSO.

2:26pm: Checked my cell phone voice mail and retrieved message from Lt. Akins requesting timeline of events.

2:27pm: TC to Lt. Akins who wanted to verify some information that she possibly missed in our meeting on 4/4/09 at the Sheriff’s Department.  I asked her if she wanted me to fax it to her, and she stated that would be fine.  She provided me her fax number.  The timeline of events was faxed at @ 2:30pm.

2:48pm: Missed call was received from Judge Bethel.

2:55pm: TC to Judge Bethel who didn’t answer at the time.

2:56pm: TC from Judge Bethel asking if I knew what the monitoring company’s understanding of what procedure(s) should have been taken place.  I advised him that I would call Ms. Franklin to see what her understanding was.  I, also, advised him that per her testimony in court, that she stated that the only thing that she did with cases was to monitor them and notify the agency when there was an alert.

3:00pm: TC from Sabrina Hill addressing the same issue from Judge Bethel, in which I told her that I would contact Ms. Franklin right away and follow-up w/her thereafter.

3:05pm: TC to Ms. Franklin to verify what her understanding of procedures was.  She stated that in the past, when there was an alert or something questionable, she would contact Mr. Hughes, and he would always state that he would handle it.  She stated she didn’t know what additional steps were being taken when there was an alert or violation.  She stated that all orders that she received came from Mr. Hughes per the Judge.  She stated he never provided her anything in writing or in a document.  It was always verbal.  She stated that because she is a civilian employee that she never went to Mr. Yancey’s home alone and that the time that she did go, she was accompanied by Mr. Hughes & Ms. Bush.  I, also, asked Ms. Franklin about her knowledge of an appointment that Mr. Yancey possibly had last month.  She stated that Mr. Hughes did not notify her prior to Mr. Yancey’s appointment on 3/14/09.  She stated she actually notified Mr. Hughes because she received an alert at 11:44am, at which time she contacted Mr. Hughes regarding the alert.  She stated that Mr. Hughes advised her that Mr. Yancey had an appointment but was outside of the office waiting because the people left the office and wouldn’t return until 1:00pm.  She stated she heard the conversation between Mr. Hughes & Mr. Yancey at some point in which Mr. Yancey asked Mr. Hughes if he could go to the bank to get some money.  She stated Mr. Hughes advised Mr. Yancey that he could go through the drive-thru but not inside of the bank.  She stated at that point she could not hear the conversation because the voices sounded muffled.  She, also, advised that Mr. Hughes stated that he didn’t notify her of the appointment because the Judge wanted to see if the system really worked and to see if Mr. Yancey was actually being monitored.
